Collection Appeals

If you disagree with an IRS collection action, such as a tax lien, levy, or IRS denial of your request for an installment agreement or offer in compromise, you can request a Collection Appeals Program (CAP) hearing with the IRS Office of Appeals. The IRS collection actions can be disastrous for both individuals and corporations. Many people assume they have no options for preventing IRS action or challenging a collection that has already taken place. The Collection Appeals Program is one such alternative.

We'll go over the Collection Appeals Program, when a taxpayer can use it, and the closely related Collection Due Process Appeals Program (CDP).

The taxpayer can also use CAP to deal with problems that arise from installment arrangements. It's important to remember that under a CAP, taxpayers can't argue the underlying tax due. Furthermore, a taxpayer cannot appeal a CAP judgment that is unfavorable to them.
